Daniel A. Scola, Jr., Managing Partner, Hoffmann & Baron, LLP, was recently featured in Forbes Advisor.

The article, “How To Trademark a Business Name” discussed the importance of protecting your business name from being copied by competitors.  Scola speaks about the process of applying for a trademark, length of time and associated costs.

Scola defined what a trademark is and the benefits and protections it offers. He stated, “Trademarks are designed to protect not only the owner but to give the public an indication that they are buying from a recognizable source. For example, when the public buys Tide detergent, they know it comes from a single source and hence they associate a certain quality with that product. The trademark signifies that it is coming from Procter & Gamble.”

A trademark can last indefinitely as long as it continues to be used and properly maintained. Maintenance must be done with the United States Patent and Trademark Office between the fifth and sixth year after registration, the ninth and tenth year, and then every ten years after that.
